LEGAL

Privacy Policy

This Privacy Policy explains what personal data we collect when you visit scale4presence.com or contact us, why we collect it, who we share it with, how long we keep it and what rights you have. We have kept the site deliberately simple so that we collect as little as possible.

Who we are

The website scale4presence.com is operated by ALI DEVELOPMENT LLC, a Delaware limited liability company, trading as Scale4Presence ("we", "us", "our").

  • Address: 8 The Green, Dover, Delaware 19901, USA
  • Email: contact@scale4presence.com

For the purposes of the EU General Data Protection Regulation (GDPR) and the UK GDPR, ALI DEVELOPMENT LLC is the controller of the personal data described in this policy.

What this website does not do

Before listing what we collect, here is what we do not do:

  • We do not set any cookies of our own.
  • We do not use analytics, advertising pixels, session recording or any other tracking tools.
  • We do not offer user accounts, logins or a newsletter.
  • We do not have forms on the site that store what you type.
  • We do not run an online checkout, and we never receive or store your card or bank details.

Personal data we collect

Emails you send us

When you email contact@scale4presence.com, we receive and keep the content of your message. This usually includes:

  • your name and email address;
  • anything you choose to tell us, for example information about your Instagram, YouTube or TikTok accounts, your goals or your questions;
  • any files or links you attach.

Please do not send us passwords, payment card details or other sensitive information by email.

Order records

If you buy a product or service from us, we keep a record of the order:

  • what you bought;
  • the amount paid and the currency;
  • the date of the order;
  • the payment reference provided by our payment provider;
  • the name and email address linked to the order.

Technical data processed by our providers

When you load any page of the site, your browser sends technical information to our hosting provider, including your IP address, browser type, the page requested and the date and time of the request. We do not use this information to identify you or build a profile of you. See the section "Service providers and other recipients" below.

The GDPR and UK GDPR require us to explain the legal basis for each use of personal data. We use personal data only for the following purposes:

  • Answering your inquiries. We read and reply to your emails. Legal basis: taking steps at your request before entering into a contract, where your inquiry is about buying something; otherwise our legitimate interest in responding to people who contact us.
  • Selling and delivering products and services. We send you a payment link, deliver digital products by email, carry out services and provide support. Legal basis: performance of our contract with you.
  • Keeping order records for tax and accounting. Legal basis: compliance with our legal obligations.
  • Handling refunds, complaints and legal claims. Legal basis: performance of our contract with you, compliance with legal obligations and our legitimate interest in defending our rights.
  • Running a secure, working website. Our hosting provider processes server logs to deliver pages and protect the site against abuse. Fonts are served from our own hosting, not from a third party. Legal basis: our legitimate interest in operating a secure and functional website.

Where we rely on legitimate interests, we have considered your interests and rights and believe they are not overridden, because the data involved is limited and the processing is what you would reasonably expect. You can object at any time (see "Your rights").

We do not use your personal data for automated decision-making or profiling that produces legal or similarly significant effects on you. We do not send marketing emails.

Service providers and other recipients

We share personal data only with the providers we need to run the site and the business:

  • Vercel (website hosting). Vercel hosts the site and processes server logs, including IP addresses, to deliver pages and keep the service secure.
  • Cloudflare (domain name, DNS and email routing). Emails sent to contact@scale4presence.com pass through Cloudflare Email Routing, which forwards them to our mailbox.
  • Our email mailbox provider. Forwarded emails, and our replies, are stored in the mailbox we use to run the business.
  • Payments. When you pay through the payment link we send you, you provide your payment details directly to a PCI DSS certified payment provider. Your card or bank details never reach us; we receive only confirmation of payment, the amount, the date and a payment reference. The payment provider processes payment data under its own terms and privacy policy.

We may also disclose personal data where required by law, to respond to a lawful request from a public authority, to establish or defend legal claims, or as part of a sale or reorganization of our business, in which case the recipient would be bound by this policy or an equivalent one.

We do not sell your personal data, and we do not share it with anyone for advertising purposes.

International transfers

We are based in the United States, and our service providers may process data in the United States and other countries. If you are in the European Economic Area, the United Kingdom or Switzerland, this means your personal data is transferred outside your country.

Where the law requires it, we rely on appropriate safeguards for these transfers, such as a provider's certification under the EU-U.S. Data Privacy Framework (and its UK Extension or the Swiss-U.S. framework, where applicable) or Standard Contractual Clauses approved by the European Commission or the UK authorities. You can contact us to ask for more information about the safeguards in place.

How long we keep your data

  • Inquiries and email correspondence: 24 months after our last contact with you, unless the email relates to an order, in which case we keep it with the order record.
  • Order records: for as long as tax and accounting law requires us to keep them, typically up to seven years after the end of the relevant tax year.
  • Data needed for a dispute or legal claim: until the matter is fully resolved.
  • Server logs: these are kept by Vercel under its own retention policy. We do not keep separate copies.

When a retention period ends, we delete the data or anonymize it.

Your rights

If you are in the EEA, the UK or Switzerland

Under the GDPR and the UK GDPR, you have the right to:

  • access the personal data we hold about you and receive a copy;
  • have inaccurate data corrected;
  • have your data erased, where there is no longer a valid reason for us to keep it;
  • restrict how we use your data in certain circumstances;
  • receive the data you gave us in a portable format, where processing is based on contract or consent;
  • object to processing based on our legitimate interests;
  • withdraw any consent you have given, at any time, without affecting processing that took place before;
  • lodge a complaint with a data protection supervisory authority, in particular in the country where you live or work. In the UK, this is the Information Commissioner's Office (ICO).

We would appreciate the chance to address your concerns first, so please feel free to contact us before going to a supervisory authority.

If you are a California resident

The California Consumer Privacy Act, as amended by the California Privacy Rights Act (together, "CCPA"), gives California residents specific rights. To the extent the CCPA applies to us:

  • Categories we collect: identifiers (name, email address, IP address), commercial information (records of products and services purchased) and any other information you choose to include in your emails. We collect these from you directly and, for IP addresses, from your browser through our providers. We use them for the purposes described in "Why we use your data and our legal bases" and disclose them only to the service providers listed above.
  • We do not sell or share personal information. We do not sell personal information and we do not share it for cross-context behavioral advertising, as those terms are defined in the CCPA. We have not done so in the past 12 months. We do not knowingly sell or share the personal information of consumers under 16.
  • Sensitive personal information: we do not intentionally collect it and we do not use it to infer characteristics about you.
  • Your rights: you may ask us to tell you what personal information we have collected about you, to delete it, and to correct inaccurate information.
  • Non-discrimination: we will not treat you differently for exercising any of these rights.
  • Authorized agents: you may use an authorized agent to make a request on your behalf. We may ask for proof that the agent is authorized and may need to verify your identity directly.

How to exercise your rights

Email contact@scale4presence.com and tell us which right you want to exercise. We may ask for information to confirm your identity, usually by replying from the email address you used with us. We will respond within one month under the GDPR and UK GDPR, and within 45 days under the CCPA. These periods can be extended where the law allows, in which case we will tell you why. Exercising your rights is free of charge.

Children

This website and our products and services are not directed to anyone under 18. We do not knowingly collect personal data from anyone under 18. If you believe a person under 18 has sent us personal data, please contact us and we will delete it.

Security

We take reasonable technical and organizational measures to protect personal data, including limiting the data we collect, relying on established providers, keeping access to our mailbox and order records restricted to the people who need it, and using encrypted connections (HTTPS) for the site. No method of transmission or storage is completely secure, so we cannot guarantee absolute security. Please avoid sending sensitive information by email.

Changes to this policy

We may update this policy from time to time, for example if we change providers or add new features to the site. The date at the top of this page shows when it was last updated. If we make significant changes, we will make that clear on this page and, where appropriate, notify customers by email.
